Based in Kuala Lumpur or in Johor Bahru , the Legal and Compliance Counsel is a member of the Legal Team of GDS's International Business and has the following main responsibilities:
To be responsible for the implementation and oversight of the Company's compliance programs, including providing compliance training, handling daily compliance procedures and processes, conducting investigations, conducting compliance due diligence in commercial transactions.
Advising on compliance matters including without limitation FCPA and anti-bribery/anti-corruption compliance, export control compliance, sanction compliance, data privacy, and cybersecurity.
To draft and review commercial agreements (such as NDAs, services agreements, real estate leasing agreements, procurement agreements, commercial agreements for complex business transactions) and participate in meetings and negotiations with internal and external parties.
To monitor changes in laws and regulations in the jurisdictions we operate in and update internal policies and stakeholders accordingly.
To liaise with third parties, governmental and regulatory authorities regarding compliance matters.
To liaise and coordinate with external law firms and manage court and arbitration processes with the support of external law firms.
Requirements:
An LLB degree or above from a reputable university in a common law jurisdiction.
Qualified to practice law in Malaysia. Qualifications or experience practicing in other common law jurisdictions is a strong plus.
At least 4 years of experience in a major international/Malaysia/Singapore top-tier law firm.
Native English speaker capable of speaking and reading Chinese, and command of basic MS Office software applications (e.g., Word, Excel, and PowerPoint).
Excellent English drafting skills and strong negotiation skills.
