Job Summary To execute the duties of a Prosecuting Officer as authorized under section 377(b)(5) of the Criminal Procedure Code. These include perusing investigation papers, conducting cases in court, provide legal opinion and others pertaining to offences under the Communications and Multimedia Act 1998, Postal Service Act 1991, Digital Signatures Act 1997, Strategic Trade Act 2010 and their subsidiary legislations.
Job Responsibilities To conduct prosecution of cases in court for offences under the purview of MCMC.To peruse investigation papers that are referred to by the Enforcement Division and prepare recommendations to the Deputy Public Prosecutor.To prepare write ups and recommendations for high profile investigation papers that need to referred to the Attorney General's Chambers.To prepare write ups and recommendations for letter of representations that are submitted by the accused to the Deputy Public Prosecutor.To give instructions to the investigating officer for the purpose of case management and trial in court.To prepare documentary exhibits and witness statements for the purpose of trial in court.To prepare reports and recommendations to the Deputy Public Prosecutor on decisions of court when the case is complete.To prepare reports and statistics on court proceedings to the Deputy Public Prosecutor.To prepare input and legal opinion on prosecution related matters.To attend meetings, engagements and projects on prosecutions related matters.To execute administrative and strategic management duties or projects that are assigned to.Qualification & Work Experience LLB (Hons) from a reputable university.Preferably candidate that has been admitted to the Malaysian BAR as an advocate and solicitor.Minimum 5 years of working experience as a criminal litigator/prosecutor.Experienced in adducing or dealing with digital/electronic evidence in court.Experience in telecommunications or cyber related matter would be an added advantage.Technical Competencies Good understanding and knowledge on criminal law, criminal procedure and evidence law.Good understanding and knowledge on the acts under the purview of MCMC such as the Communications and Multimedia Act 1998, Postal Service Act 1991, Digital Signatures Act 1997, Strategic Trade Act and their subsidiary legislations.Good command of English and Bahasa Malaysia, both in writing and speaking.Good with computer and social media.Able to conduct courts proceeding independently.Able to handle engagements/meetings with the internal and external parties and provide opinion on prosecution matters function.Able to execute administrative and strategic management duties.Behavioral Competencies Pleasant personality with good communication and interpersonal skills.Has high level of integrity and professionalism.Able to work independently, yet has strong teamwork spirit.Analytical, organised and could handle multiple tasks at one time.Responsible and accountable to all works/task assigned.Able to complete all instructions/assignments/task given within stipulated time.This is a permanent position located in Cyberjaya.
